Why DigiLawyer is the Right Choice for Women?

Is This Even a Legal Case?
Even if you think that this incident is impossible to prove and don’t have valid evidence, our female lawyers will assess your situation and guide you better on whether and how to file a complaint.
Real-life Scenario 1
A woman agrees to meet with a person she trusted a lot. The assault took place when each of them had their drinks, and she communicated her lack of interest.
And when she said NO, that person raped her, and the person owes her money as well. She has no evidence and is unfamiliar with how to deal with both matters.
How the law applies
Even if the woman doesn’t have a medical report or strong evidence to back her case, the rape case can still be pursued.
As per section 114, Bharatiya Sakshya Adhiniyam 2023, which replaced Indian evidence act (1872), the court will consider her testimony even if she doesn’t have medical reports or any physical evidence.
Lack of evidence doesn’t guarantee your case will fail.
Real-life Scenario 2
A 19-year-old girl has faced domestic violence at home; his father abused her since she was 13 years old, and he brutally hit her, insulted her and controlled every aspect of her life. She reported this incident to the police, and they said it was a family matter; they couldn’t do anything and dismissed the case.
How the law applies
- Under Indian law, the Protection of Women from Domestic Violence Act, 2005, protects her from such physical and emotional abuse by family members or their husbands.
- Police have to take this incident seriously and record this domestic incident report.
- If police don’t take her seriously and refuse to take action, the victim has to approach the senior police authority, the state women’s commission or the National Commission for Women.
Women’s Safety: Know Your Legal Rights & Protections
Specific laws and frameworks have come up to provide equal rights to women against domestic violence, sexual harassment, abuse by family or partner and entitle them to get equal rights in property.
1. Protection from Domestic Violence (DV act, 2005)
If you’re harming the women through any of the ways such as physical, emotional, sexual, economical or mental abuse, it counts in that. Under this act, women have the right to seek:
- Protection order

- Any sort of monetary relief
2. Right Against Dowry Harassment If you’re harassed or harmed because of dowry, then the dowry prohibition act (1961) give you power to file a suit under section 498 A of IPC.
Right to a Safe Workplace (POSH act, 2013) Under the POSH act 2013, if a colleague or senior demands sexual favors, makes inappropriate remarks or gestures, or engages in unwanted physical contact, the POSH Act protects her and allows her to:
- Raise a complaint at the workplace
- Approach the Internal Complaints Committee (ICC)
- Take legal action if the ICC fails to act or provide relief
3. Protection Against Cyber Crimes (IT Act 2000) IT act, 2000 protects women against various forms of online violence, such as cyber stalking, cyber bullying, image-based sexual abuse, online gender-based hate speech, etc.

This has become a common concern online. You can file a zero FIR at any police station regardless of where the crime/incident happened. Later, the FIR will be forwarded to the concerned police station.
If you’re sexually harassed or you face unwelcome messages, such as showing pornography images, then you can file a complaint to the Internal Complaint Committee (ICC), which is made within each organization under the POSH act, 2013.
If a father, brother, uncle, cousin, in-law or any relative has sexually harassed or assaulted you, it’s a criminal offence under Indian law, not a family matter.
If someone leaks your photos online, then it’s a criminal offence which comes under section 66E, 67, and 67A of the Information Technology Act, 2000.
You can report such online harassment and cyberbullying complaints to the official government portal (cybercrime.gov.in) and even report the incident to the social media platform.

- Contact the women’s helpline number (1091)
- File a police complaint under the dowry laws
