What is GST?

GST stands for goods and service taxes. GST Registration is the process through which a business gets officially registered under the Goods and Services Tax (GST) system in India. It means the business is recognized by the government as a supplier of goods or services, and it's legally allowed to collect GST from customers and pass the tax credit to buyers.

In simple terms, if you're running a business that crosses a certain annual turnover limit, you're required to register for GST. Once GST registration is done, your business gets a unique GSTIN (Goods and Services Tax Identification Number).

GST Registration is governed under the Goods and Services Tax Act, 2017, under Section 2(52) that defines "Goods and Services Tax" means any tax levied on the supply of goods, services or both, except taxes on the supply of alcoholic liquor for human consumption.

GST Number

GSTIN (Goods and Services Tax Identification Number) is a unique 15-digit number assigned to every business registered under GST in India. It is used to identify taxpayers, track tax payments, and ensure compliance within the GST system.

Let's breakdown these digits in

  • Where the first two digits represent the State Code (01–37) where your business is registered (e.g., "27" for Maharashtra, "09" for Uttar Pradesh).
  • While the next nine digits i.e. 3-12 represent PAN Number (e.g., "ABCDE1234F"), this ties your GSTIN directly to your income-tax identity.
  • The 13th digit represents an Entity Number that distinguishes multiple registrations under the same PAN within a state (most businesses will see "1" here).
  • The 14th digit represents Default "Z" is reserved by the system (always "Z" unless the format changes).
  • While the last 15th digit represents Checksum Character: An alphanumeric digit calculated by a formula to validate the entire GSTIN.

GST Registration Certificate

The GST Certificate is an official document issued by the Indian government to businesses registered under the Goods and Services Tax (GST) system. It confirms GST registration and includes key details like the GST identification number, business name, and registered address. To stay compliant, businesses should complete the online GST registration process and obtain this certificate.

Having a GST Certificate is important because it allows businesses to:

  1. Collect GST legally – You can charge GST on sales, showing compliance and building trust.
  2. Claim Input Tax Credit – Recover GST paid on purchases, reducing overall costs.
  3. Access loans more easily – Lenders often require it to verify business legitimacy.
  4. Apply for government contracts – It's typically mandatory for tender eligibility.
  5. Enhance credibility – Demonstrates transparency and adherence to tax regulations.

  1. Visit the GST Portal: Go to the official GST website and click on "Register Now" under the taxpayer section.
  2. Enter Basic Details: Fill in your business name, PAN, mobile number, email ID, and state, then verify using OTP to generate a TRN.
  3. Complete Application: Log in using the TRN and fill out the full registration form with business, and address details.
  4. Upload Documents: Submit the required documents such as PAN, Aadhaar, address proof, and bank details.
  5. Verify & Submit: Authenticate your application using DSC, or Aadhaar OTP and submit it.
  6. Receive ARN: After submission, you will get an Application Reference Number to track your status.
  7. Get GSTIN: Once approved by authorities, your GSTIN and registration certificate will be issued.

This is usually the most tedious and long process and is often costly as well.

  1. Consult a Tax Professional: First, you'll need to find and coordinate with a CA or GST practitioner, explain your requirements, and schedule time to begin the process.
  2. Gather and Prepare Details: Collecting accurate business information, PAN, Aadhaar, address proofs, and contact details can take time, especially if documents are not readily available.
  3. Share Documents: You'll have to organize, scan, and securely share multiple documents, and may need to resend them if anything is unclear or missing.
  4. Follow-ups: Expect some follow-ups, corrections, or additional information requests before everything is ready for submission.
  5. Application Filing: The consultant will then enter all details on the GST Portal, which can take time depending on complexity.
  6. Verification Process: You'll still need to be available for OTPs or DSC for verification at the right time, which can sometimes be inconvenient.
  7. Track ARN Status: After submission, you'll need to keep checking the application's status and respond if any queries are raised.
  8. Receive GSTIN: Finally, once everything is reviewed and approved, your GSTIN and certificate are issued.

Who needs GST Registration in India?

Business exceeding turnover limits

  • Goods: Businesses with an annual turnover that exceeds Rs. 40 lakh (Rs. 20 lakh for special category states) must register for GST.
  • Services: Businesses with an annual turnover that exceeds Rs. 20 lakh (Rs. 10 lakh for special category states) are required to register.
  • Any businesses supplying goods or services through e-commerce platforms or e-commerce operators themselves must register for a GSTIN number.
  • Casual Taxable persons: Any person who occasionally supplies goods or services in India must obtain GST registration.
  • Non-Resident taxable persons: Foreign businesses supplying goods or services in India need to obtain GST registration.
  • Voluntary Registration: If a business decides to voluntarily register for GST, even if it’s below the threshold limit, they can. This allows the business to avail of input tax credits (ITC) and be more competitive in the market.
  • Input Service Distributor: If a business is involved in distributing input tax credit across various branches or units, it must register as an Input Service Distributor.
  • TDS/TCS Registrations: Businesses or certain platforms that are required to deduct or collect tax at source.

GST Registration for Different Business Types

The process and documents required vary by business structure. Here is what you need to know:

GST Registration for Sole Proprietorship

If you are a sole proprietor, you and your business are the same legal entity. You will need:

  • PAN
  • Aadhaar
  • Business address proof
  • Bank details
  • Photograph

Most sole proprietors complete new GST registration within 2 to 7 working days.

GST Registration for Private Limited Company

Requires:

  • Company PAN
  • Certificate of Incorporation
  • MOA and AOA (Memorandum of Association and Articles of Association)
  • DIN (Director Identification Number) and DSC (Digital Signature Certificate) of directors
  • PAN and Aadhaar of the authorized signatory
  • Address proof
  • Bank details
  • Board resolution

GST Registration for LLP (Limited Liability Partnership)

Requires:

  • LLP agreement
  • PAN of the firm and all partners
  • Aadhaar of partners
  • Address proof
  • DIN and DSC if applicable
  • Bank details

GST Registration for Freelancers

Freelancers providing services above Rs. 20 lakh annually must be registered. Even below the limit, GST registration is recommended to claim Input Tax Credit and appear more credible to clients.

GST Filing for Small Businesses and Startups

gst filing for small businesses and gst return filing for startups can feel overwhelming at first. The key is understanding which returns apply to you: most businesses file GSTR-1 and GSTR-3B monthly or quarterly, plus an annual return. DigiLawyer handles all of this so you never miss a deadline or pay an avoidable late fee.

Penalties for Non-Registering Under GST

  • Penalty - The standard penalty is 10% of the tax amount due, with a minimum of ₹10,000. But if the authorities see it as a deliberate case of tax evasion, the penalty can go up to 100% of the tax owed.
  • Tax Liability from the Past - Your GST liability doesn't start from the date you apply it starts from the day you became liable for registration. So, you’ll have to pay tax on all sales made since then, along with interest for the delay.
  • Can’t Claim GST - Without GST registration, you can’t collect GST from customers. You also lose out on Input Tax Credit (ITC), which means you’ll end up paying more on your purchases and business expenses.
  • Business Restrictions - Many e-commerce platforms, tenders, and contracts require GST registration. Not having one could restrict your opportunities and make your business look non-compliant or untrustworthy.

Why is GST verification essential?

GST verification is crucial for businesses as it safeguards against fraud and ensures legal compliance requirements are met.

Fraud Prevention

Verifying the GST numbers helps businesses avoid working with fraudulent businesses. Since tax authorities are closely monitoring GST fraud, checking GST numbers regularly helps protect your business from potential financial losses and legal issues.

Input Tax Credit Protection

To claim input tax credits (ITC), businesses must ensure that their suppliers are registered and compliant under GST. By verifying GSTINs, companies can be sure they're working with legitimate suppliers. This protects their ITC claims and ensures they don't face unexpected issues later.

GST rules require that businesses provide accurate registration details. If a business doesn't verify GST numbers, they could face penalties, legal troubles, or damage to their reputation. Using automated GST verification tools helps businesses stay compliant and reduces the risk of penalties from incorrect or outdated records.

Enhanced Credibility

Conducting GST verification boosts trust with clients, partners, and financial institutions. It shows that a business is serious about compliance and integrity, which can enhance its reputation in the market and make it more attractive to work with.

Operational Efficiency

Real-time access to GST data allows businesses to make better decisions when onboarding vendors, setting credit terms, or managing risks. This leads to smoother operations and fewer disruptions, making it easier to keep things running efficiently.

Avoiding Financial Losses

Neglecting GST verification can result in financial consequences, such as penalties for claiming credits from invalid GST numbers.

Streamlined Processes

Using online GST verification tools simplifies the process of checking GSTINs. This makes it quicker and easier for businesses to ensure that their suppliers are compliant with GST rules, without the need for long and complicated manual checks.
