Types of Power of Attorney DigiLawyer Provides

1. General Power of Attorney

A General Power of Attorney gives the person you choose broad authority to manage legal matters such as bank accounts, property transactions, and financial matters like paying bills or signing legal documents on your behalf. GPA registration is recommended for most property-related matters.

2. Durable Power of Attorney

A Durable Power of Attorney stays valid even if you become mentally or physically unable to make decisions. It covers finance, healthcare, or business Power of Attorney needs.

3. Special Power of Attorney

A Special Power of Attorney gives your Agent limited authority for a specific task, such as selling a property, managing rental agreements, or legal representation. SPA registration is required when the task involves immovable property.

4. NRI Power of Attorney

An NRI Power of Attorney is specifically designed for Non-Resident Indians (NRIs) to manage their affairs in India

5. Medical Power of Attorney

A Medical Power of Attorney allows the person you choose to make healthcare decisions for you if you are unable to do so. This may include approving or refusing treatments or choosing doctors or hospitals.

6. Springing Power of Attorney

A Springing Power of Attorney becomes effective only under specific circumstances, usually if you become incapacitated. This involves

  • Handling your money and property if you become unwell
  • Taking care of legal matters when you can’t do it yourself

7. Property Power of Attorney

A Property Power of Attorney is used specifically to authorize someone to buy, sell, lease, or manage property on your behalf. It is one of the most common types in India and is often needed for Power of Attorney for selling property or Power of Attorney for property management. Registration is mandatory for this type.

8. Business Power of Attorney

A Business Power of Attorney allows a trusted person, such as a partner or senior employee, to sign contracts, make financial decisions, or represent your company in legal matters. It is commonly used when the business owner is unavailable or traveling.

Note Choosing the correct type of POA depends entirely on your specific business or personal needs. Read our detailed guide to fully understand how Power of Attorney in India works.

Parties Involved in Power of Attorney

1. Principal: The principal is the person who authorizes someone else to act on their behalf. They decide what powers to give and for how long. If the principal is mentally capable, they can change or cancel the Power of Attorney at any time.

2. Agent or Attorney: The Agent is the person chosen by the principal to act for them. The Agent must follow the instructions given and always act in the principal's best interest. They handle tasks and make decisions as allowed in the Power of Attorney.

Power of Attorney registration charges and stamp duty vary by state and by the type of POA

1. For a General POA

Stamp duty is Rs.500, if the agent is a close relative. And the registration fee is Rs.100.

Stamp duty is 1-5 percent of the market value of the property or the consideration amount, whichever is higher, if the agent is not a close relative. The registration fee is also 1 percent of the value.

2. For a Special POA

Stamp duty is Rs.100 but may vary according to states. Registration is mandatory if your Special POA is dealing with property.

Note- The cost may depend on your state’s exact rates. Always check with your local stamp office website or authorized stamp vendor.

Planning for medical decisions: A medical POA will allow someone to make medical choices on your behalf if you're unable to communicate. This is especially important in emergencies or serious illness

Managing finances and property: A POA lets your agent pay bills, manage investments, handle taxes, or even sell property if needed. This keeps things running smoothly if you’re unavailable.

Convenience when you’re unavailable: Even if you're perfectly healthy, you might need a POA if you're traveling, working abroad, or simply unable to handle certain decisions in person.

Supporting aging or long-term care planning: A POA can become a core part of estate planning when cognitive or physical functions decline.

Running a business smoothly: Business owners often use POAs to allow partners or trusted individuals to make decisions or sign documents in their absence.

NRI property management: If you live outside India and own property here, an NRI Power of Attorney for property in India lets you authorize a trusted person to handle buying, selling, renting, or managing your property without you having to travel back.

Revoking a Power of Attorney: You can cancel a POA at any time. The revocation of Power of Attorney must be done in writing and all relevant parties such as banks, the registrar, and your agent must be notified. DigiLawyer can help with this process as well.
